Protesters called for an end to the practice of trying children as adults, three strikes laws, life sentences, life without the possibility of parole, and the death penalty.They did not call for the dismantling of the prison system or an end to the practice of incarceration, as Chip Johnson implies here.
In San Quentin-- and in prisons across the country—inmates are subjected to solitary confinement, sometimes for decades. Kids as young as 13 are tried as adults and sometimes sentenced to life without the possibility of parole. In three-strikes states, people are sentenced to decades in prison for non-violent crimes that sometimes amount to less than a couple hundred dollars in damages. And in death penalty states, state-sponsored execution means that lives, sometimes innocent, are thrown away.
Twenty-four US states do not have three strikes laws, many countries cap prison sentences at 15 years regardless of the severity of the crime, and only one European country- Belarus- continues to impose the death penalty. The United States incarcerates its citizens at a rate that far surpasses any other country in the world; second on the list in Rwanda.
Conditions and laws like these have spurred decades of prison reform and prison abolition activism, both from inmates and supporters on the outside. Feb. 20, this movement joined with Occupy Oakland to protest outside San Quentin prison and demand that these issues be addressed.
As protesters arrived, organizers blasted music, hoping to reach the ears of prisoners. Dozens of prison guards and representatives from the Marin County sheriff’s department were stationed in front of the prison gate, and well as on hills looking down on the protest group.
The loud music continued with a performance from the Brass Liberation Orchestra, and subsequently a drumming ritual.
“As First Nations people, we’re no strangers to occupation. We’re also no strangers to prison. The first prisons were the reservation and the slave plantation,” said George Galvis, Executive Director of Communities United for Restorative Youth Justice.
“We have post-colonial stress disorder in our communities,” added Galvis.
Author, film producer (Redemption: The Stan Tookie Williams Story) and 2006 California gubernatorial candidate Barbara Becnel helped facilitate the event.
In her opening statements, Becnel praised the crowd, packed with Occupy activists, family members of incarcerated people, formerly incarcerated people, and others.
“We should really be proud of ourselves today. Because today, we are history makers. We have merged the prison rights movement with the Occupy movement,” said Becnel to an eruption of applause.
Throughout the program, speakers read solidarity statements addressed to Occupy Oakland from prisoners across the country, including Mumia Abu Jamal, Leanard Peltier, Kevin Cooper, and group statements from Pelican Bay human rights organizers, and those involved in state-wide prison strikes in Georgia.
A movement has coalesced around the claim that Cooper, a death row inmate at San Quentin since 1985, is innocent. Cooper was denied an appeal in 2009 in a ninth-circuit court case in which five judges dissented, declaring that, “the state of California may be about to execute an innocent man.” Their 103-page dissent statement includes descriptions of evidence tampering leading to Cooper’s conviction.
Cooper helped call for the Occupy 4 Prisoners day of action.
Speakers at the rally called for Cooper’s freedom, and for the end of death row entirely.
Becnel related a story about some prisoners, charged with life without the possibility of parole, that she had met while campaigning against the death sentence for Stan "Tookie" Williams.
The men, Becnel said, told her: "We only leave here in a casket also. We are also dead men walking."
Speakers also decried the use of solitary confinement as a punishment in prisons.
Sarah Shourd, known for her imprisonment in Iran after accidentally crossing the border during a hike, spoke along with fellow imprisoned hikers Josh Fattal and Shane Bauer.
Shourd, who was held in solitary confinement for 14 months, related her experiences.
“After just two months my mind began to slip. I would spend large portions of my day crouched down by a small slot in my door, listening for any sounds from the outside that might distract me from the sheer terror of my isolation.”
A statement from a Texas prisoner, read by an Occupy Wall Street organizer, also addressed solitary confinement.
“We tend to think of man as a collection of individuals, each complete in himself, who just happen to come together to satisfy certain needs. Actually, however, there is nothing distinctly human that can be exhibited by an individual in isolation,” said the philosophical letter.
The Pelican Bay Hunger Strike last year highlighted solitary confinement, and prisoners demanded an end to the practice, in which inmates are held in isolated rooms with no sunlight for 23 hours a day, often for years on end. Some inmates at Pelican Bay have been held in these conditions for over 30 years.
Organizers of the hunger strike called it off when the California Department of Corrections promised to investigate the issue, but started to strike again several months later when no changes had been made to any of the conditions that they were protesting.
Kelly Turner, 42, who was sentenced to 25 years to life for writing a bad check for $146.16 in 1997, was also placed in solitary confinement for one year. However, she focused her speech at the rally on California’s three strikes law, the legislation that turned what would have been a three-year sentence for forgery into a possible life sentence for Turner. Turner said she was lucky that good pro bono lawyers defended her, and would likely still be in prison had they not; she now owns her own business.
Turner, who advocates for Families to Amend California Three Strikes (FACTS), urged the crowd to vote for an initiative to amend the law that is slated to appear on the California ballot this November.
In her speech, Turner described meeting women in the Central California Women’s Facility is Chowchilla that were also serving decades-long sentences after having been charged with a third strike.
“I am here today for the woman that was on my dorm that had 27 years to life for drinking a 99 cent lemon line soda out of a store. Or the woman who stole a jar of Vaseline, a bottle of vitamins, two pairs of boxers,” said Turner.
Tatiana, a young prisoners rights advocate who spent time in juvenile hall, read a statement from incarcerated youth Veronica Hernandez.
Hernandez, 20, has been imprisoned since age 16.
She was tried as an adult, an outcome that she attributes to a public defender who did not do his best to fight for her.
"There are no law libraries or legal services at juvenile hall, so a juvenile, for better or for worse, is entirely dependent on his or her court-appointed attorney, and must trust that he or she will lead them in the right direction. Unfortunately for me, that direction was to adult court. I now face a life sentence should I be convicted," said Hernandez in her statement.
No speaker argued for the dismantling of the prison system, instead focusing on what they saw as unjust sentencing and inhumane treatment in prisons.
In a statement calling for Occupy 4 Prisoners, Kevin Cooper connected a call to end the death penalty with struggle for correct racial and economic justice and an end police brutality:
“America has a deep-seeded philosophy in which it only allows for the execution of its poorest people. These seeds have taken root and have grown in such a way that no person who this system sees as a ‘have-not’ is safe from the death machine. Whether they are within (San Quentin) or on a BART platform.”
Bauer also expressed the importance of tying prison rights to the Occupy movement, saying, “This Occupy movement needs to permeate the prisons. God forbid one day some people here will be on the other side of this fence. But when movements get strong, people start getting locked up. We should know this. This happens in every country. Prisons are places where movements are killed. But at the same time, when movements successfully permeate prisons, a space built to break people down, the movement is at its strongest. This is true all over the world.”
Occupy Oakland organizers have already been hit with bizarre and seemingly invalid charges, such as “lyching,” “bike,” “boat,” and umbrella. In one of the most extreme cases, Khali, an Occupy Oakland protester, may face life in prison after being arrested for a allegedly taking a blanket out of a garbage can. Advocates for Khali say that he was denied prescription medications in jail for ten days before allegedly assaulting a police officer; his third strike.
Well-known prison rights advocate and former Black Panther Elaine Brown ended the program. After remarking that “there aren’t enough songs in this movement,” she sang Oh, Freedom as the crowd peacefully exited the site, as several volunteers picked up any trash that was left behind.
“Before I’ll be a slave, I’ll be buried in my grave, and go home to my comrades and be free,” sang Brown.

Seal Beach OKs sex offender ban for beach, pier and parks

SEAL BEACH – Sex offenders will be banned from this town's beaches, parks, jetties, pier and the adjacent parking lots under a new law given initial approval Monday night.
"We're sticking up for the kids," said Orange County District Attorney Tony Rackauckas, urging the City Council to approve the ban that is modeled on a similar county law.The Seal Beach City Council voted 5-0, without any discussion, to approve the law.(On Monday, Cypress relegates registered sex offenders to a particular part of the city.)
If adopted at the next meeting, Seal Beach would join a growing number of Orange County cities that have created similar laws targeting sexual predators. They include Huntington Beach, Irvine, La Habra, Laguna Hills, Lake Forest, Los Alamitos, Mission Viejo, Rancho Santa Margarita, Westminster, Yorba Linda and the county itself.
Fullerton was the first city in Orange County to bar sex offenders from loitering within 300 feet of parks, schools and daycare centers. County Supervisor Shawn Nelson and Rackauckas last April crafted the county law barring registered sex offenders from county parks, harbors, historic sites and beaches. Some of the city ordinances are modeled after the county's law but vary from it. Irvine, for example, passed a narrower version focusing on offenders who victimize minors.
The laws have been criticized as overly broad, unconstitutional and difficult to enforce.
In Seal Beach, there are 10 registered sex offenders, according to a staff report. Seven of the 10 live in the retired senior community of Leisure World, one lives in College Park East neighborhood and another one lives in the Hill neighborhood, north of PCH. The 10th offender is registered in the Oakwood Apartments but he no longer resides there, according to the staff report.
Called a "child safety zone," the new law would make it a misdemeanor for registered sex offenders to enter recreational areas where children gather. A first conviction would lead to a maximum of six months in jail or a fine up to $500 or both.
California has a number of measures to protect children from sexual predators, who are required to register their addresses with law enforcement.
The laws include: Jessica's Law, a 2006 voter-approved act that requires, among other things, all registered felony sex offenders to be monitored by a GPS device while on parole and bans them from residing within 2,000 feet of any school or park where children regularly gather; Senate Bill 1128, a 2006 law that prohibits sex offenders from entering school grounds without written permission; Chelsea's Law, a 2010 law that includes increases in penalties, parole provisions and oversight for offenders who have attacked children.
The general public can access a sex offender database, with the addresses of registered sex offenders, at meganslaw.ca.gov.

Christian Gomez, 27, died at Corcoran State Prison, just six days after he and about 30 fellow prisoners began refusing food. Gomez was one of thousands of California inmates who have staged hunger strikes in 12 prisons since July after the U.S. Supreme Court ruled that California prison overcrowding was causing "needless suffering and death" and ordered the state to reduce its number of prisoners. We speak with Gomez’s sister Yajaira Lopez and to attorney Carol Strickland of the Prisoner Hunger Strike Solidarity Coalition. I pussed out of the Mainline in CA Prisons after spending 15 years there and it was one of the best decisions in my life. Mainlines in CA Prisons can be extremely dangerous. I was scared shitless a number of times over the years and sweated it out daily that my jacket had a sex beef on it. Very, very risky. On my one and only PC (they call them Sensitive Needs Yards now) yard I was surprised to see gangs there. I thought a guy went PC to get away from all that crap. Fucking morons. I spent a year and a half in PC and never had any trouble there like I did on the Mainline, but the gangs did fuck with other guys. I hear in the wind that PC is going to be the new Mainline and everybody in General Population will be locked down. I also hear that CA is going to make some yards just for SO's. Who knows? Sex offenders are an easy set of criminals to condemn. Their offenses are reprehensible. Politicians can get a lot of mileage out of seeming tough on crime when they load up their sentencing requirements.
But when does the list of penalties become too outrageous? Do lawmakers and the governor believe sex offenders can’t be rehabilitated? Can someone have served his time and move on, or because it is a sex offense, is that impossible?
A recent legal argument over sex offenders is raising those questions.
A federal judge this month threw out a Louisiana law banning certain sex offenders from Facebook and other social networking sites, saying it was an unreasonable restriction on constitutionally protected speech that could keep them off the Internet entirely.
The law, which took effect in August, made it a crime for anyone convicted of a sex offense against a minor or of video voyeurism to use networking websites, chat rooms and peer-to-peer networks.
Gov. Bobby Jindal and lawmakers said the ban was designed to keep sex offenders from seeking out children in online forums.
“The Internet is the virtual playground where sex offenders are trying to strike and prey on our kids. We must have the tools to crack down on monsters that are preying on our kids,” Jindal said in a statement.
The law, according to U.S. District Judge Brian Jackson, also could bar the offenders — including those who have served their time in prison and on parole — from reading news websites, searching for jobs online and working in positions that involved the Internet.
That type of isolation could make it impossible to re-enter society.
Jackson said the prohibition went too far, infringing on constitutional rights.
“Although the act is intended to promote the legitimate and compelling state interest of protecting minors from Internet predators, the near total ban on Internet access imposed by the act unreasonably restricts many ordinary activities that have become important to everyday life in today’s world,” Jackson wrote in his ruling.
During a hearing a few months before his ruling, Jackson noted the statute would appear to ban the sex offenders from even using the federal court website.
Conviction of the crime of unlawful use or access of social media carried a prison sentence of up to 10 years. A second conviction required a prison sentence of at least five years and up to 20 years.
The ACLU of Louisiana sought to overturn the law on behalf of two sex offenders identified as John Doe and James Doe. John Doe is from East Baton Rouge Parish and was convicted in 2002 of possessing child pornography. James Doe is from Iberia Parish and pleaded guilty in another state to having a sexual encounter with a minor, according to court documents.
Jindal vowed to appeal Jackson’s ruling.
“Louisiana families should have the comfort of knowing their children are able to go online without the threat of sex predators. It’s offensive that the court would rule that the rights of sex predators are more important than the rights of innocent children,” the governor said.
In recent years, Jindal has made a crackdown on sex offenses among the centerpieces of his legislative agenda each year. He’s signed into law bills that allow for chemical castration of sex offenders, lengthened jail sentences and expanded monitoring and restrictions on where they can live and travel.
Lawmakers have gone along with nearly every proposal Jindal offered. They balked, however, on a measure to allow the confinement of sex offenders beyond their prison sentences, by involuntarily placing them in mental health facilities for treatment.
The Legislature will get a chance to revisit the Facebook ban in the upcoming session that begins March 12.

STRASBOURG (Reuters) - Germany should stop the "degrading" practice of surgically castrating sex offenders, the anti-torture panel at Europe's top human rights watchdog said on Wednesday.Under German law, serious sex offenders can volunteer for the operation as part of their treatment.
The Strasbourg Council of Europe's anti-torture committee said the procedure was rare in Germany, with fewer than five cases a year over the past decade.
But surgical castration was mutilating and irreversible and there was no evidence it prevented men from committing new sex crimes, the committee said in a report on Germany.
"Surgical castration of detained sexual offenders could easily be considered as amounting to degrading treatment," said the report.
"Therefore, the Committee recommends that immediate steps be taken by the relevant authorities to discontinue in all German Laender (federal states) the application of surgical castration in the context of treatment of sexual offenders," it added.
The German government said in an official response to the report that the practice was under review but it believed there were medical grounds for continuing to offer the operation.
Under German regulations, a sex offender can be castrated if he ask for the procedure, is older than 25 and gets the approval of a panel of experts.
The Czech Republic is the only other European country to allow sexual offenders to choose surgical castration. The committee's report on Wednesday only focused on the situation in Germany.
A less invasive chemical procedure, that blocks the creation of testosterone, is a mandatory treatment for offenders in some U.S. states and in Poland.
Other countries let sex criminals choose this form of chemical castration.

STOCKTON, CA - The Stockton city government had a highly publicized eviction of homeless squatters at a shanty town down in Mormon Slough last week.
However, further down the Slough, by Jefferson and A Streets, a different campsite was quietly dismantled; it was the long time home to dozens of sex offenders.
"All of them, the 20 that were there, couldn't find housing that was compliant with Jessica's Law," California State Parole Delta District Administrator Julie Kaplan said. "Homeless shelters they can't go to, because they're family shelters with children and women. Some found businesses that gave them permission to stay on private property."
Kaplan said when transient sex offenders are evicted, the parole agents have to scramble to keep tabs on them.
The California State Parole District in Stockton currently has 20 transient registered sex offenders under its watch. San Joaquin County Probation Department has seven homeless sex offenders. Both agencies track sex offenders with GPS ankle bracelets.
"We get five minute increments on a map that show exactly where that offender has been," SJC Probation Department Assist. Chief Stephanie James said. "We can also set up exclusion or inclusion zones and if the offender steps somewhere where he shouldn't be, his agent is notified immediately."
One homeless registered sex offender said the GPS device must kept charged.
"We're tracked. A computer tells them exactly where we're at and it sets off an alarm if you're violating," said the offender, who wished to remain anonymous.
Kaplan said a week after the city's eviction of Mormon Slough, many of the 20 registered sex offenders are now back at Mormon Slough. The campsite now sits further out of view from the above neighborhood on A Street.
"They let their parole agents know they were moving back or near that area," Kaplan said.
On Wednesday afternoon, a homeless sex offender registered at the probation department that he was now staying in Mormon Slough.
"We did verify that this morning that he was in fact at Mormon Slough yesterday," James said.
James had no probationary sex offenders staying in Mormon Slough prior to the city eviction last week.
While law enforcement agencies know where homeless sex offenders are at all times, citizens do not. The state sex offender online registry does not list the last known location of transient sex offenders.
"It's unnerving, because you don't know who's down there or how many," said a mother living in the neighborhood above Mormon Slough.
"We went down there to play on dirt bikes and saw a lot of tents," said 17-year-old Tracey Jenkins.
Jenkins found out sex offenders were living below her neighborhood after she and her friends stumbled onto their camp.
"Now I can't go anywhere by myself and I stay away from there. It freaks me out," Jenkins said.
A few neighbors in the neighborhood above Mormon Slough said they still feel safe in their neighborhood despite the sex offender campsite.
"They keep to themselves mostly," one mother said. "If they keep a good eye on them, then it's fine."
Homeless sex offenders on parole must register every 30 days at the nearest police station. Those on county probation report to their parole agent every Wednesday.

No one in their right mind would argue this fact.The victims of sex crimes deserve our compassion, sympathy, and full support. We of Californians Against Jessica's Law (CAJL) would never wish to add to the anguish, tragedy, and harm true victims have endured. However; in the last three decades the hysteria over sex crimes, both real and fabricated, has become political and huge profits are being made off of the detection. apprehension, prosecution, defense, incarceration, supervision, control, and treatment of the sex offender and those wrongly convicted. The Sex Crime Witch Hunt Nightmare, as it is now known, is a multi-million dollar industry in California. With these kinds of profits to be made, The Sex Crime Witch Hunt Nightmare, has caught tens of thousands of innocent men and women in It's ever widening web who now must endure the life-long Scarlet Letter of being a convicted sex offender. 63,000+ Californians are now required by law to register with the police as convicted sex offenders and this number continues to grow daily with no end in sight. These tens of thousands must also submit to sex offender community notification that plasters their faces, descriptions, and other personal information all over the internet warning their communities of their presence. Numerous studies have indicated that these internet postings do little to protect the public from true sexual predators. What California's sex offender notification websites does do is create unnecessary fear in the community, mistrust, and promotes violence. Murder, brutal attacks, and other forms of violence has been directed at those unfortunate enough to appear on CA's sex offender web sites. The Sex Crime Witch Hunt Nightmare is about to get alot more nightmarish for the 63,000+ registered sex offenders,both the innocent and guilty, and their families if Jessica's Law is passed by voters on November 7th, 2006. Jessica's Law is an ill conceived and mean-spirited scheme, but highly profitable to a select few, that will force all registered sex offenders in California to wear GPS Tracking Shackles on their ankles 24 hours a day for the rest of their life's. A life-long sentence of having their every move tracked by GPS with freedom only coming with death. If anyone refuses to wear these degrading, all intrusive GPS Tracking Shackles for the rest of their lives he or she will be charged with a felony and sent to prison. In some cases, given a life sentence. Absolute nightmares do not get any worse. The harm done if Jessica's Law passes will be immeasurable. In the United States and especially in California, The Sex Crime Witch Hunt Nightmare has been raging for over 30 years now. The War on Sex Offenders hysteria has produced untold misery and the causalities in this profit-driven and revenge-driven "war" has been enormous. No wonder they want Jessica's Law to pass so badly. We wonder how many in law enforcement and D.A.'s offices own stock in GPS Tracking Shackles and plan to make a killing in November 2006? Studies indicate that the yearly cost to implement, maintain, and run the Jessica's Law scheme/scam will be well over 200,000,000 dollars a year. Don't worry. It's only taxpayer money. These tax dollars to fund this scheme will no doubt come from education funding for our children or services for the poor. Jessica's Law sure won't protect the public, but it's going to make some officials, their business partners, and their cohorts stinking rich. All thanks to California taxpayers.

* Prosecutors- Everyone hates the sex offender and loves the brave district attorney who punishes them. D. A.'s love accusations of sex crimes. No other crime is easier to convict and generates more publicity. There is no defense once an allegation is made. Sex crime convictions are a slam dunk for over zealous persecutors. The more sex crime conviction notches on their gun belts they can show voters come election time, the better. They must show voters they alone are tough on sex offenders. Convictions, convictions, convictions is all that matters to persecutors,especially when it comes to sex crimes. The truth, justice, or decency plays no part to the new breed of persecutors in the U.S. All they care about is their position and of course money.

* California's Prison Industry- The CA prison guard union is the most powerful union in California's history. It's hunger for fresh, warm bodies to fill their prison beds and justify their existence is insatiable. Sex offenders are just another commodity to them. The CA prison system is the largest state prison system in the world with no end in sight. 170,000+ souls now inhabit CA prison warehouses. The Sex Crime Witch Hunt Nightmare has been very, very good for the CA prison industry. One of their biggest money makers that will only continue to feed It more and more fresh bodies.

* Special Sex Crime Units- With The Sex Crime Witch Hunt Nightmare going full steam almost every city in California has a special sex crime unit, even if it is unneeded. If sex crimes were not out of control and sex offenders were not lurking everywhere these special sex crime units would not need to exist and the high paying jobs would not be justified. Follow the money to find the true motives for law enforcement's War on Sex Offenders.

* Corporate Media's- Sex sells and crime sells, combine the two, sex crimes, and you have a run away best seller. Corporate media's have spread The Sex Crime Witch Hunt Nightmare across the U.S. like a virus. It makes little difference to them that sex crimes are not epidemic in this country, that sex offenders are not falling out of trees, and 99.9 % of men would not commit a sex crime. * Victims Rights/Revenge Groups- Some victims rights/revenge groups have gone totally overboard in their efforts to seek revenge on offenders, especially so-called sex offenders. Some of these groups have become the pawns of California's powerful and corrupt prison guard union who make huge profits by putting more and more California citizens in prison. These victim rights/revenge groups are funded by the CA prison guard union to be their mouth pieces to promote prison expansion to CA's media's. As long as these victim rights/revenge groups continue to be the puppets to the CA prison guard union they will continue to receive their blood money.

* Sex Offender Treatment Providers- Sex offenders are the bread and butter to the sex offender treatment industry. No sex offenders? No big house in the hills. No college for the kids. No big bank accounts. Of course they are going to promote The Sex Crime Witch Hunt Nightmare. Every sex offender on parole must submit to sex offender treatment, needed or not. It's nothing personal, just business, a multi-million dollar business in California.

*The Man-Hating Feminist Movement- A small, but well organized, minority of radical, man-hating, so-called feminists have totally taken over the mainstream feminist movement. To them, all men are not only pigs, but also rapists and child molesters. Fathers are especially hated by this group. Every man deserves to be punished. The more men in prison the better. The corporate media's accepts all their hate-filled rhetoric and propaganda without question.

*Parole Officers- Parole alone is a billion dollar a year waste of taxpayer money in California. After the prison industry is done feeding off of offenders, the CA state parole offices get their turn to make money off them. Sex offenders are pure profit for them. They are the easiest to recycle back to prison because everyone despises them anyway. Parole officers are some of the highest paid employees of the Dept. of Corrections. The Sex Crime Witch Hunt Nightmare is just job security for them and money in the bank.

Why should we stop at internet postings and GPS Tracking Shackles for the 63,000+ registered sex offenders in California? No life-long Scarlet Letter is too harsh, too restrictive, too abusive, or too nightmarish for them! Why don't we-

* Force them to get "DANGER! SEX OFFENDER" tattooed on their foreheads.

* Force them to wear glow-in-the-dark clothing for easy identification at night.

* Force them to live on islands under 24 hour a day video surveillance.

* Force them to have GPS Tracking Devices implanted under their skin or drilled into their teeth.

* Force them to place giant billboards on their front lawns warning their neighbors of their evil presence.

* Force them to publicly denounce their access to human rights, civil rights, and constitutional rights.

* Force them to get sterilized because they will no doubt attack their own children.

* Force them to get both arms amputated and legs too while we're at it.

Or better yet, why don't we just shoot anyone in the head that is accused of a sex crime? No trial is necessary. They are all guilty anyway. Well maybe shooting them in the head immediately after any allegation of a sex crime is not the answer. Not because it would be insane to do, but because those who profit off The Sex Crime Witch Hunt Nightmare would lose a lot of votes, would lose money, and lose control if those accused were executed on the spot. Much better to just continue to ruin the life's of the 63,000+ registered sex offenders in CA and ruin the life's of their families too. Alot more profitable that way. More money in the bank, more votes in the ballot box, and life-long job security.

The makers of GPS Tracking Shackles will profit the most tax payer monies if Jessica's Law passes on November 7th, 2006. The stock holders who own shares of stock will make profits in the tens of millions per year. All at tax payer expense of course. They will become millionaires literally over night thanks to Jessica's Law. You can believe the makers of these horrible devices, those who will be maintaining them, and those who will be monitoring them, will be laughing all the way to the bank come November 2006 if Jessica's Law passes. The makers of these modern day, barbaric shackles know that GPS tracking of sex offenders is only the beginning. If Jessica's Law passes it will no doubt mutate in a couple years to laws that force all parolees to wear these shackles, then all ex-felons, maybe deadbeat dads, then immigrant guest workers, people on welfare, and/or anyone one else The State deems worthy of tracking their every movement. Like the prison industry now in California, the GPS Tracking Shackles industry will become a growing multi-billion dollar industry soon. Also like the prison industry it will mostly target the poor, uneducated, those without power, people of color, and anyone else The State deems undesirable. Jessica's Law is just the first stage. Everyone despises the sex offender, guilty or not, and they deserve no rights anyway. No one will argue against Jessica's Law and then expanding It to other undesirables. We wonder if the politicians and persecutors screaming the loudest to get Jessica's Law passed actually own stock in the makers of GPS Tracking Shackles or will receive a healthy "donation" once Jessica's Law is approved by voters.

There are over 63,000+ registered sex offenders in CA. Experts predict that it will cost tax payers $10 a day to fully implement Jessica's Law. This includes the cost of the GPS Tracking Shackle itself, the costs to maintain them, the costs to repair them, and the tremendous costs to monitor all 63,000+ of them 24 hours a day. At $10 a day for 63,000+ it will cost taxpayers well over $230,000,000 a year for the Jessica's Law scheme. That is the low figure. Others say it will cost a lot more. Where exactly will over a 1/4 billion dollars of taxpayer monies a year come from to keep this scam going every year? Should we raise taxes? Take it from services for the elderly? Take it from educating our kids? How about taking food out of the mouths of the poor and children to pay for Jessica's Law scam of the century. Crooked politicians and corrupt district attorneys tell us that no amount of money is enough to "save our kids" from the unrestrained legions of child molesters that inhabit every street in California. That only with GPS Tracking Shackles on everyone who has ever been convicted of a sex crime will our children truly be safe. Of course a large percentage of taxpayer funds redirected toward the Jessica's Law scam will go directly into the pockets of those who are advocating the passage of Jessica's Law the loudest and into the pockets of their friends and business partners. Another thing these sex offender internet notification postings do is promote crime and vigilantes. After appearing on these websites those forced to submit to them and their families have been attacked, beaten, robbed, and even murdered. It's a deadly Catch-22 for those who find themselves branded with the Scarlet Letter of a convicted sex offender. Refuse to submit to appear on a sex offender notification website and be charged with a felony or go on The State's revenge seeking websites and risk having yourself or family members attacked or even murdered. Either way, a person branded a sex offender is marked for victimization for the rest of their life's. They are not the only one's who suffer a life-long sentence of humiliation, degradation, and zero privacy. Their family members suffer right along with them. Will The Sex Crime Witch Hunt Nightmare ever end? Please vote NO on Jessica's Law on November 7th, 2006 and stop one aspect of the living hell 63,000+ Californians and their families face daily.

Another part of Jessica's Law in California will make 2000 feet (almost a 1/2 mile) around areas where kids may be present so-called "predator free zones" off limits to those on CA's sex offender registers. Those who advocate Jessica's Law use the typical scare tactics and propaganda telling voters that their children will only be safe if we implement "predator free zones" around our schools, parks, and daycare's. Any so-called sex offender living within the 2000 feet limit of Jessica's Law will be forced to move immediately or be arrested. People who have lived in their homes 20, 30, 40, or more years without any trouble will be forced to move or go to jail. Where will they all move to? Within California cities few areas are not a 1/2 mile from schools, parks, and daycare's. In states that have already enacted Jessica's Law 90 % or more of "sex offenders" were forced, with threats of arrest, to find a new place to live. Most of those evicted became homeless, along with their spouses and children who also suddenly found themselves driven from their homes. Jessica's Law 2000 foot so-called "predator free zones" will do nothing for public safety and only generate more fear and mistrust. It will however break up families, cause incredible harm, and waste police time as they make sure the 2000 foot limit is adhered to. "Sex offenders" who have for years followed the requirement to register will be forced to go on the run and live "underground" because they and their families are unable to find housing because everywhere is within 1/2 a mile of schools, parks, and daycare's. The Sex Crime Witch Hunt Nightmare has found It's best ally, Jessica's Law, that will force tens of thousands of Californians to become homeless.

The life's of the registered sex offender, guilty or innocent, does not appear that it could get worse. Now comes Jessica's Law that will not only cost CA taxpayers hundreds of millions of dollars wasted a year, but like the internet postings, do little to protect the public. What Jessica's Law will do is further stigmatize, punish, and ostracize not only registered sex offenders, but also their family members. Why stop at GPS Tracking Shackles for sex offenders? Why not all ex-felons? Why not everyone who crosses our borders? What about the mentally ill? Why don't we just implant a GPS Tracking Device in every man, woman, and child in California? Then we really will be safe from one another. The State could also collect DNA samples from all Californians to be stored in a police database until needed. Or maybe The State can collect information about all aspects of every Californian and post it on the internet, so no one in California could "hide" personal information from their neighbors. It's all for our own good. The State only wants what's best for us. Even if we don't know it yet. We sure wouldn't live in the Land of the Free anymore, but we sure will be safe and secure from one another. Who needs rights, liberties, freedoms, or the pursuit of happiness when we could be 100% safe and live in a Police State Utopia. Jessica's Law is just one of the many first steps we are headed toward this U.S. Constitution hating utopia. We must come together and fight Jessica's Law before it is too late. Please, join the fight. If not for yourself.... for your children.

	I am a Black Transgender On parole with the California Department of Correction I have to register as homeless with LAPD. I am HIV and I am Sleeping in the street in the skidrow area. My Parole officer in Inglewood states that I can not sleeping in a house and if I do I will be arrested. I have a GPS TRACKER on my leg. I don't know what to do I talked with the supervisor concering the matter of me sleeping in the street. She refused to see me I am doing every thing I am suppose to do with the Department of Correction. 	I agree with the writer 100%. My poor mentally ill son was falsely accused over ten years ago of a sex crime by a child who came from an unbelievably dysfunctional family. (3 criminal uncles (one a convicted pedaphile), a drug addict/prostitute mother and older sister and a home that the girl who accused my son would later call a "crack house". My son had very very bad legal representation by a lawyer who gave us 15 minutes to make the Alford plea decision. What he didn't say was that it was a felony (even though this was asked), that Ken would have to be on the registry and that it was the same as a guilty plea in the eyes of the law and public. My son is presently in prison (2 yrs.going on 3) for going to a snowball stand and being recognized by people who said they wanted to use him as an example even though he committed no crime. He was on probation for being one day late for registering a change of address. I fear for my son's life, safety and mental condition. And I also fear for where can he live when he gets out? He was 36 when this happened and had no more than a traffic ticket on his record. The Baltimore media did a week-long blitz sensationalizing his case with all three tv channels every day for a week and The Sun newspaper all doing a black and white portrayal. It wasn't until the City Paper did an objective piece that he got a small measure of fairness. But he is still in prison with godknowswhat happening to him.

	My husband was convicted almost 10 years ago now of a sex crime that did not even involve a child. He as well as myself are treated like dirt by closed minded individuals that live around us. Anyone getting to know us, finds that we are just like every other couple out there...........Trying to live a decent life. Even though my husbands crime that he was convicted of(court appointed attorney said to either accept the bargain with the guilty plea or face 10 -15 years in prison)did not involve a child, he is still treated like a child molester. People that live around us won't talk to either one of us. The Megan's Law site is part of that issue. Before it went public it was said to be the way to find child molesters in your area. Well guess what, not all people on that site are child molesters. They and their families are treated like they are though. This new Jessica's Law will only make things that much worse. How does anyone that supports this law think that these people will continue to live. Many of these people will lose their jobs as well as their homes. Someone facing a move to the "country" also needs to face the reality of much more expensive housing. How many apartment buildings do you know of in the more rural areas. I don't know about other people but there is no way that we could afford to buy something. Why would we anyway. There is always that chance that some other ridiculous law will be passed and we would have to sell our home. Some would say that that is not their problem. I think it is everyones problem. One of the biggest mistakes that I think people make that are voting for Jessica's Law is that they think a "law" will protect them. If someone is planning to find a child to molest, what makes anyone think these people will stop at these "new" safety free zones. Just because you won't live within 2000ft of a school or park doesn't mean you can't get to one. Molesting a child is a way worse offense than passing a safety free zone area. If they are going to molest, there is no imaginary line that you can draw that will keep them out. Passing a law like Jessica's Law as a blanket punishment for all registered sex offenders is wrong. There are varying degrees of killing someone. Why not start treating them all the same!! Because it wouldn't be fair. Just like this law is not fair to all.

	Jessica's Law (Prop 83)is poorly conceived and certainly a result of political pandering to a certain public hysteria. further, it has prooved counter productive in states where it has been put into practice. perhaps even more alarming than the unconstitutional character of jessica's law is the potential for it to be extremely dangerous to the population-at-large. tens of thousands may be forced into a desperate, untenable situation. many of these individuals could well resort to criminal activity to sustain themselves, eventually becoming a direct threat to all via armed robbery, assault, burglary and similar egregious and life threatening acts. being forsaken and exiled by society leaves little hope of undertaking a life with any productive merit. some, perhaps many, who would never consider this type of criminal activity under other circumstances could feel compelled to commit serious crimes and thus greatly endanger others. fear of the system and the consequences of their actions could well become negligable for these individuals...even to the point of committing a crime for the express purpose of being reincarcerated. protecting children is of the utmost priority, but measures such as jessica's law endanger all citizens of california, including children. the options for an rso if the law is enforced to the letter are, for most, to comply and become indigent or go underground. neither of these are in the public interest. gps devices can be removed. those required to register simply won't. these people will vanish; large percentages of rso's who had previously complied with their requirement fall off the radar. this has already happened in iowa. some of these individuals could do much damage before being apprehended and if we are talking about only a few who are potentially truely dangerous, then they are a few out of 60,000 to 90,000 and growing...a few too many. i believe there may be a terrible irony within jessica's law: legislation named to protect the most innocent of society instead becomes an instrument of danger for all society. there are better ways to address the issue than to adopt primitive knee-jerk law.

	Proposition 83 appears to be motivated by greed and seeking fame by the politicians who have proposed 83. No other class of person is treated this way in California. The repeat offense rates for sex crimes is under 3%. Prop 83 costs too much, is probably unconstitutional and will encourage RSOs to go underground.

My girlfriend's ex husband finally found a way to punish his ex and sue her for child custody. He found a crzy zealous DA and worked the system until the witch hunt worked. i never touched anyone- I should have fought the charges, but stupidly gave in so "it would be all over". I guess it will never be over. This idiotic law will help no one but the greedy people listed in your essay. I'm concerned about the GPS issue. 	I just spoke to an Attorney and was told that there are 7 lawsuits already against Jessica'a Law that will tie this disaster in the courts for years if it passes. 	I am the fiancee of a registered sex offender. In 1985, he was working as an engineer and selling drugs on the side (a major mistake, of course!). One day he tried to collect on a drug debt. He, along with the two others, was indicted and he was facing 60 years for a long laundry list of charges, most of them bogus. The DA in Oklahoma eventually dropped all but 3: misdemeanor drug, felony kidnapping (they prevented the woman from leaving) and rape (a totally false accusation.) At first he had an attorney which he paid for, but then he ran out of money. He was forced to rely on the public defender. He had exactly one meeting with the lawyer and was told if he didn't accept these three charges, he would face 60 years, a life sentence in name. So he pleaded guilty. He received 10 years and 10 years probation. He ended up doing 5 years and 10 years probation. Now his name in on the Megan's List, even though he hasn't had a criminal offense for 20 years. Since the home is mine, my name is up there, too. Of course he's innocent, but he's learned that he really can't do anything. There's much more to the story but I am feeling very dejected right now. J.A., an innocent man who spent 10 years in an Oregon prison after being falsely accused in 1985, former prison escapee and fugitive from justice, prisoner's rights and men's rights activist, cofounder of Californians Against Jessica's Law (CAJL) in 2006 and founder of Society Against False Accusations of Rape (SAFAR) in 1990, and author is missing and has said to have left the country. J.A. was captured in July of 2008 and given a 4 year prison term for refusing to register as a SO. On 10/23/2010 he was released and is now serving a 3 year parole sentence in Santa Clara Co., California that has turned out to be a true nightmare. James now has a GPS Tracking Device locked onto his ankle 24/7. He has to charge it up twice a day for an hour each time and if his shackle loses power he will be sent back to prison. James has also find it next to impossible to find a place to live due to new residential restrictions that make 80% of the Co. off limits to him. He can not enter a school, park, ect..... or will be immediately arrested. If he stays for more than 2 hours in a forbidden area (80%) he is in violation of Jessica's Law and will be sent back to prison. James has begun filming a documentary film entitled, " I Was a Fugitive from the Sex Crime Witch Hunters " that will chronicle a month of being on parole in CA and trying to comply with the insane, new Jessica's Law. James will never give up his more than 20 year battle with the so-called Just-Us System. Much more later.

	I am married to a P.C.290. He took a deal 12 years ago for sexual battery against his ex-girlfriend.I had a chance too meet the victom and her mom in 96. They wanted to drop the charges against Jacob Hoffman. The D.A. would not listen. As a result of being scared He took the deal. He had a Public Defender who said Jacob could not win... The victom was tring to get His $18000.00 S.S.I. backpay. As a result of this case He has had to register as a sex ofender For Life. Jessicas Law has made our lives a mess.. Now not all P.C.290's are gilty of messing with childeren. However Jessicas Law is way, way overboard. I feel that Jessicas Law should be a case by case basis. Some of the charges against some people are false.REVENGE,DIVORCE,STATUATORY RAPE (her 17/him 18 or 19), I personally know that alot of teens that are lieing to men about their age to have sex with older men because it's cool......... So if I can help FIGHT to get Jessicas law repealed. Tell me how THANK YOU MRS.HOFFMAN

	I am a little disturbed by your commentary atating that once an offender, always an offender. Is your degree in psychology? There are a lot of people that are falsely accused and spend 25 even 50 years in prison due to the Jessica's Law. Ummm, do not know what rock you have been living under, but I would not consider that to be fair. Also the people that offend that have a mental illness or are mentally retarded? Are they supposed to be stauck in a prison when they are not even able to defend themselves. I know of a case where a mother left her child with a person that she knew was mentally retarded with anger issues as well, and you can only guess what has happened to him, but where is her fault... You can't say that she does not have any because she does. Not every case can be treated the same, point blank.

	yea I say run and live free. i was convicted in 91 in a military court served 4 years in leavenworth and was released on parole. i completed my parole and married my high school sweet heart and have been togeether for ten 11 years and married for 10. law in my state just changed. previous law was anyone convicted after 1992. then in 2005 they changed it to anyone convicted after 1986 im not registered yet and if I am forced to I will be leaving the country. I would rather live in a third world country free rather than suffer the punishment of registration for life. my crime was almost 20 years ago and was deemed by a the state phycologist unlikely to reoffend. and well adjusted to completed treatment programs mayybe we shool start registries for convicted murders and burglers dont want them in my neigghborhood wither

My brother is going to get out of jail soon, and we were planning on him moving in with me, but his parole officer told him he couldn’t because he has to register as a sex offender and I live too close to an elementary school, which is against “ Megan’s Law” or “ Jessica’s Law” or something like that. Isn’t there anything we can do? I’m afraid if he doesn’t live with me he will be homeless.

California’s Megan’s Law requires anyone convicted of a wide range of crimes, including forcible sex crimes involving non-consenting adults and most sex crimes involving children, prostitution, and child pornography, to register as a sex offender upon release on parole or probation or discharge from custody. California Penal Code § 290. Proposition 83 (PDF), the Sexual Predator Punishment and Control Act, or “Jessica’s Law (PDF),” which amended Megan’s Law on November 8, 2006, forbids any registered sex offender from living within 2,000 feet of a school or park where children regularly gather. California Penal Code § 3003.5(b).

Your brother is not alone in facing a very bleak prospect. According to the Prison Law Office, a nonprofit public interest law firm which engages in class action and other impact litigation on behalf of prisoners, these residency restrictions have forced many parolees to become homeless because they are unable to find affordable, compliant housing.

Jessica's law has been challenged in courts as being too restrictive. Your brother may wish to ask a court to review his case. The Prison Law Office, which has been involved in many of these challenges, has produced a packet of forms and instructions that parolees can use to ask for an immediate stay of the restrictions while their individual cases are being heard by the courts. San Bernardino officials consider ordinance to restrict the number of sex offenders living in one location

In one case, more than 20 registered offenders were discovered living in the same Budget Lodge motel near the Colton-San Bernardino city limits. NBC4's Craig Fiegener reports.

The San Bernardino City Council is trying to decide how to restrict the number of sex offenders living in one location. In one case, more than 20 registered offenders were discovered living in the same Budget Lodge motel near the Colton-San Bernardino city limits.

The Budget Lodge's management said it's a place where offenders can stay in compliance with the law.

"Everybody always said they feel more safe here and it's really quiet," said Budget Lodge front desk manager Kelly Thill.

Some motel customers stay a few days, while others stay a few weeks. And, if the guest has a record, the management will find out about it.

The Budget Lodge is not breaking any rules when it comes to housing sex offenders. The nearest school is about 2,000 feet away. It has recently been remodeled and it offers four different types of rooms. And, it is located in a remote area along the 215 Freeway.

If the city council decides to implement an ordinance to restrict so many registered sex offenders from living in the same motels, it would clash with state law. Currently, there are no rules on the number of people living in one location.

"They have to go somewhere," adds Thill. "It's away from schools and parks."

The city of San Bernardino is home to 600 sex offenders. The Megan's Law website shows several homes are being shared by registrants on release.

Prison psychologist in alleged rape scheme fired

SACRAMENTO, Calif. --         A California prison psychologist charged with faking her own rape has been fired from the prison system.
A spokeswoman for the California Department of Corrections and Rehabilitation told the Sacramento Bee on Wednesday that Laurie Ann Martinez's last day with the department was Dec. 22.
Her firing came less than a week after the state psychology board announced it was suspending the 36-year-old Martinez's license.
Martinez is accused of staging her robbery and rape in April at her home with the help of a friend and then dialing 911.
Sacramento authorities say she and her friend, 33-year-old Nicole Snyder, have acknowledged the scheme. Martinez was allegedly trying to get her husband to move to a more desirable neighborhood.

It’s been a while since I’ve heard California prisons referred to as “country clubs,” an absurdly outrageous politically generated misnomer. When “free people” learn of prisoners,handcuffed and shackled at the ankles,beaten with metal batons by rampaging guards;forced to stand naked,outdoors,in broiling sun or polar cold,for hours on end,for no particular reason;dying in their cells from heart attacks while guards,busy watching TV,refuse to respond to their calls for help until it’s too late,they are appalled. “What third-world country would do that?” they ask. When told the “country” is California,all 33 of its prisons,many shrug as if to say “So what?”
There’s a flaw in our cultural convictions that makes some Americans horrified when they hear of prisoners in other countries being abused like this,while simultaneously they seem to think it’s perfectly acceptable to punish prisoners in our own country with various forms of maltreatment that are not only inhumane and indecent but also in many cases in defiance of international law.
Boston Woodard,Prisoner B-88207,has experienced all these abuses and more,and omits nothing in his first book,Inside the Broken California Prison System. This 251-page compilation of articles,originally published in the Community Alliance over the last six years,sweeps the dirt back out from under the rug. Not dramatized,he simply tells it as he sees it,clearly and credibly. The book’s 44 essays display excellent investigative journalism skill and integrity. The appendix lists 39 prison advocacy resources,a virtual goldmine for activists,students and families of prisoners.
I’ve known Boston for upward of 15 years and have visited him a few times. A seventh-grade dropout morphed into a self-educated jailhouse journalist,he has dedicated his quarter-century sojourn to educating “free people” about what really goes on inside. He makes it clear that his writings are not his gripes;he doesn’t whine. Nor does he write because of,or about,“prisoners’ rights”—in reality,they have none,since the First and Eighth Amendments carry little clout inside prison walls.
Rather,he writes to enforce the public’s right to know what their tax dollars are being wasted on:a huge,corrupt and dysfunctional prison system that serves no useful purpose. The California Department of Corrections and Rehabilitation neither corrects nor rehabilitates. An employee,who must remain anonymous,says it should more accurately be named the “Department of Corruption and Revenge.”
“Know the truth and the truth shall set you free,” the Bible says—unless you’re telling the truth about the prison you’ve been in for decades,in which case it will get you thrown in the “Hole” (solitary confinement),beaten up by vengeful guards,fed starvation rations and once again be granted the privilege of watching the “Goon Squad” demolish your few personal possessions.
What do you call a man who knows the truth and reports it,not just once,but hundreds of times,fully aware that his “reward” will be abuse? What makes him tick?
Prison authorities call him Liar and Troublemaker. Prisoners I visit,with whom I’ve discussed Woodard’s articles,have called him Glutton for Punishment,Hero and Crusader. Mike Rhodes,Community Alliance editor,calls him Journalist. I call him Poster Boy,who proves a formerly semi-literate,once-violent criminal can educate,reform,rehabilitate and redeem himself,with no help from the “system,” and become a productive citizen. I also call him Dear Friend.
Boston Woodard,B-88207,is all that and more. So what does make him tick? A hunger for true justice? A thirst to reveal evil and corruption in the prison-industrial-complex? He has been in several California prisons,moved from one “joint” to another whenever a warden gets fed up with his revelations. Boston has personally experienced,or witnessed,the events he writes about. He is dedicated to bringing his knowledge of the truth,previously well-concealed by the power structure,to the surface,to inform the public of the inhumane cruelties their tax dollars’ support.
I’ve been inside many prisons in California,other states of the United States and Great Britain,as a visitor,a volunteer,a journalist and an investigator with medical-legal teams. I’ve seen enough to make my skin crawl:prisoners who were beaten nearly to a pulp by vengeful guards;prisoners with physical disabilities whom guards repeatedly “accidentally” tripped and caused to fall. I’ve heard the lies concocted by public information officers (PIOs) to cover up beatings and other misdeeds. I’ve seen and heard enough to enable me to vouch for the veracity of Woodard’s stories.
Many U.S. prisons are new,shiny and state-of-the-art,but prisoners are treated no better than cattle at a slaughterhouse. Treating prisoners with ordinary human decency is considered “coddling” and offends “tough-on-crime” devotees. The predominant attitude among Americans seems to be that “they committed a crime so they deserve to suffer.”
The apparent goal of imprisonment in the United States,and particularly in California,is to humiliate and dehumanize. Staff appear to want to make prisoners,while inside,meaner,angrier and more violent than they were before incarceration,leading to recidivism. That,in turn,provides eternal jobs for members of the cartel that calls itself an association:the CCPOA (California Correctional Peace Officers Union),aka the guards.
Some prisons (not all) in the United Kingdom are old and the cement is crumbling,but in all that I’ve seen there,prisoners are treated with respect and dignity. The goal in the United Kingdom and other industrialized countries is to educate the inmate and prepare him to leave prison a better person than he was when he entered,so that he will not reoffend.
Woodard says,“The convict always gives respect to those prison staff [and all others] who display respect,” which is how I observed inmate/staff relationships in the United Kingdom. He says,“I just want the guards and prison officials to do what is demanded of me and every other prisoner in the system,and that is to obey the law and follow the regulations.”

Calif. judge to uphold postcard-only mail for inmates

Judge said she planned to deny a petition filed by several inmates over the ban enacted more than a year ago

VENTURA COUNTY, Calif. — A judge said she intends to uphold a policy that prohibits Ventura County jail inmates from receiving mail in envelopes and says senders must use postcards.
In a tentative ruling issued Tuesday, Ventura County Superior Court Judge Rebecca S. Riley said she planned to deny a petition filed by several inmates over the ban enacted more than a year ago.
Managers in the Ventura County Sheriff's Office say they imposed the rule in October 2010 to promote safety and to prevent drugs, weapons and large amounts of cash from being smuggled into jail in envelopes.
But the ban drew protests from angry relatives and a legal challenge.
Chief Deputy Public Defender Michael McMahon petitioned for court relief in January 2011, calling the practice an 'exaggerated response' to security concerns.
He said the ban violates the Constitution's guarantee of equal protection because the prohibition exists only in Ventura County jails, not elsewhere in the state.
The ban originally applied to incoming and outgoing mail, but the Sheriff's Office ended the prohibition for outgoing mail last year.
On what she called the sole remaining issue of incoming mail, Riley ruled the Sheriff's Office had met the standards set out in a 1987 U.S. Supreme Court decision on prisoner communications.
Riley said the Sheriff's Office had provided legitimate reasons for the rule and had allowed alternative ways for inmates to exercise their rights.
She rejected the inmates' argument that the jail had a "ready alternative" for the practice because employees can inspect the mail.
"This 'alternative' is not reasonable due to the amount of time consumption for the jail to inspect each piece of incoming mail," she wrote. "A random inspection would not reach the same result."
Attorneys for the inmates and for the sheriff said they expect Riley to uphold the tentative ruling in a court order. The judge asked the Sheriff's Office to write a proposed order for the court's review by Jan. 13.
McMahon called the tentative ruling a setback but saidhe intends tofile a new case in state appeals court if the final order goes against him.
"We're not done," Mc-Mahon said. "I'm in for the long haul."
Jeffrey Held, a private Oxnard attorney representing the Sheriff's Office, said Riley ruled absolutely correctly.
A federal court in Arizona already has ruled that a postcard-only policy is constitutional and legal, he said.
"We were relying heavily on that precedent," Held said.
The judge said she had been leaning toward an exception for inmates serving longer than a year, under California's realignment law.
Starting last fall, the state began shifting to county jails lower-risk inmates who would have gone to state prison. Some may serve more than 10 years in jail, attorneys said. Riley, though, wrote that she has reconsidered that position on further review. "The court finds those 'musings' to have been illconsidered," she said. The inmates have argued that the rule causes them unnecessary distress and limits their ability to communicate with clergy members, doctors, family and friends. No other county jail or state prison in California has the restriction, McMahon said.
Sheriff's officials say people can communicate with inmates by sending multiple postcards as large as 6½ by 11 inches. The restriction does not apply to correspondence between inmates and their lawyers.

Welcome to Healing Wives, the only known online resource for wives, ex-wives, and girlfriends of sex offenders.
Since my husband was arrested in January 2000, I have spent hundreds of hours searching the Internet for resources to help me deal with the traumatic events since he was charged with molesting our neighbor. Although statistics show that at least 75% of child molesters are currently married or divorced, there are very few resources written specifically for the spouses of such offenders. Why?
One reason is that women feel too ashamed or embarrassed to seek out help. The stigma attached to my husband's crime, as well as fear of retribution against him, has led me to live a secret life that few people know about. Another reason is that people generally have no sympathy for partners of molesters because they incorrectly assume the woman must have known what was going on and failed to protect the child. It is often thought that a woman will have to choose between her husband or her children. What about women who choose both? It is possible to support your husband through recovery while supporting your children through their healing. Even women who decide to leave their husbands will always be the ex-wife of a child molester. Women need guidance to help them through this legal and emotional battle. The shock, anger, betrayal, isolation, and feelings of disgust are hard enough to deal with but then we are faced with unfamiliar experiences involving legal hearings, the media, lawyers, and child protective services. It's an emotional roller coaster that no one should have to ride alone.
Fortunately, I now know that I am not alone. In the past year, I have met several other women online who understand what I'm going through. The details of our situations vary greatly. Some of us have husbands at home, some are in prison. Some of us are married, some are not. Some of us have children, and some of us don't. The common bond between us is that we all have partners who are attracted to minors. We find comfort in each other's support for our healing, just as the men we love need our support in their recovery.

My Blessings of 2011

It's been a tough year, but I do have alot of Blessings from 2011. Here's a short list:

- I wasn't sent back to prison/jail

-This was the longest I've not been a convict or fugitive since 1988

- No one harassed, humiliated, or degraded me all year

- I turned 50

- Kept this Blog going all year

- I quit smoking

- Have not used alcohol or drugs

- My health is good

- I started medication for PTSD/Depression

- Had a roof over my head all year

- My van didn't break down

- Fought a good fight against The Sex Crime Witch Hunt

- Made some new friends in our fight

- and on and on

Yes, I have been blessed this year. I have to remember that when times get tough. I'm all pack up and ready to move into my new motel tomorrow. I can only stay a month, then I'll be forced to move again. Oh well, what can a guy do. I have 22 months left on parole here in CA. After I complete It I'm headed back to Alaska. HAVE A GREAT NEW YEARS EVE !!!

Yep, I'm back. Really went off the deep end for a few weeks. Came close a couple times to cutting this damn GPS Shackle off my leg and hitting the road again. Being a fugitive has long been second nature to me. Have rabbit in my blood. With the stress of complying with Jessica's Law and with the holidays I went nuts for awhile. My mother, father, grandmother, and sister all died within a span of a couple years. I miss them dearly and the holidays really bring out my heartache. I was a fugitive in 2008 and could not attend my sisters funeral. The Police/FBI would have been laying in wait. I will be moving from this Fleabag motel on New Years Day to another Fleabag motel down the street, but have been told I will only be allowed to live there for one month and will be forced to move again. My P.O. told me he doesn't care if I wind up living on the streets because I'm a sex offender. As always, I had to inform him I am not a sex offender. We got in a heated argument outside my current motel room that was heard by my neighbors. To make a long story short, I have gotten on medication to deal with this all. Jessica's Law was/is driving me crazy. How are we suppose to live under such conditions? It's pure insanity. Hopefully I can hang on until Oct. 23rd, 2013 and I can get the hell out of California. I have land in Alaska given to me by my tribe. I'm 1/2 Aleut (Alaskan Native). Was a commercial fisherman back in the day. Have you ever seen Deadliest Catch? I've done that. Worked out of a dozen ports in Alaska. I want to build myself a cabin and be left the hell alone. 22 months to go and I can tell California's Jessica's Law to shove it. Sorry about the flake out. 25 years of fighting this battle will drive anyone over the edge. The medication seems to be helping. I'm back on track. Thanks for being my friends. We need each other's support.

Mountain View police said that a 16-year-old girl who told officers she had been sexually assaulted in Whisman Park in late September has recanted her story.

On Oct. 14, police spokeswoman Liz Wylie issued a press release reporting that the girl had been groped by two men in a bathroom in Whisman Park sometime between 6 and 6:30 p.m. on Sept. 26, 27 or 28.

Wylie said on Oct. 21 that the girl had "confirmed to us that no assault of any kind occurred."

"Due to her status as a juvenile, I will not be releasing any more information what-so-ever as to how we know it didn't happen, what she said to us, etc.," Wylie wrote in a press release, sent out at about 3:30 p.m. "In the same way that people sometimes legitimately delay reporting very real crimes for various personal reasons, sometimes people report crimes that did not at all happen for various personal reasons."

Wylie added, "The important thing is that there (are) not two men out there attacking women."

California Governor Jerry Brown has had mixed results on a range of policy initiatives during his first year back in office, but one of his most successful efforts may be the rapid decline in the state's teeming prison population. On Tuesday (December 27), corrections officials detailed just how swift the inmate decline has been.

California prisons have been shedding about 900 inmates a week and are nearly on pace to meet the aggressive target set by the U.S. Supreme Court earlier this year, when it ordered the state to reduce its prisoner population to 110,000 inmates by the spring of 2013, according to the San Francisco Chronicle. "As of today," the paper reported, "the state’s prisons held 134,804 inmates," with the reduction in numbers just 1,800 less than an initial goal set by the high court in advance of the 2013 deadline.

Earlier this year, the California inmate population exceeded 150,000, as Stateline noted in an April feature about overcrowded facilities. That huge population, and the state's long-running effort to reduce it, led the U.S. Supreme Court to intervene in May, citing unconstitutionally bad prison conditions.

The state's response to the high court was to pass a prison "realignment" plan, which went into effect in October and requires low-level offenders to serve their time in county jails rather than state facilities. While the plan has had the intended effect of easing the state prison population, many counties say they cannot handle the influx of new inmates. Some law enforcement officials have said that the policy is a dangerous one.

From the state's perspective, however, low-level offenders should not be serving time in state prisons anyway, and the Brown administration is pressing forward as it tries to comply with the Supreme Court order. "The progress puts the state exactly where it said it would be in an August court filing," the Chronicle reports, noting that the next target is to reduce the prison population by another 10,000 inmates — to 124,000 — by June 27.

Found a "Home"

With my upcoming eviction due to Jessica's Law residential restrictions I found a temporary "home". Another hotel. One of the only hotels in this county that is in compliance to the Jessica's Law 2,000 foot "Predator Free Zones" that cover 75+% of this county. I've been living in the same hotel now for over a year, but the city is building a park down the street and I have been ordered to move by Jan. 1st, 2012. The hotel I'm currently staying in on a Hotel Row with 4 hotels that RSO's stay in because there's nowhere else to live. All 30+ guys have been ordered to move or be arrested. I'm one of them. Now get this. My room is about 1,990 feet away from this upcoming park. I'm being evicted for 10 feet? Absolutely insane. Well, the hotel next to me has 5 rooms that are o.k. and I have already reserved one and will be moving into it on New Years Day. What a relief. I sure wasn't looking forward to living in my van. Last time I lived on the streets was when Jessica's Law was passed by voters in 20006 , so I jumped parole and left the state. I lasted 2 years until my arrest when a neighbor ratted on me for growing marijuana (never said I was an angel) and I was extradited back to CA. It was the 3rd time I walked on a commercial plane in chains to be brought back. Never again. I plan to finish parole no matter what this time and never be in handcuffs again. Don't think I would of made it on the streets again. Too dawn old. The rabbit is run out of me. Plus, like I said before - the bastards always catch me anyway. Speaking of being old. I turn 50 on Friday. 50 years old. Holy Shit! This whole nightmare started when I was 24. Over a quarter century ago. Found a place to hold up for awhile until Oct. 23rd, 2013 and I finally get off parole. Hope time flys, so I can get out of this state. Keep up the good fight.

Lake Forest to Ban All RSO's From City Parks?

I have about 2 years left on parole here in California and one of the things I most look forward to is going to a park, kick back in the sun, play baseball, have a picnic, ect.... If things keep going like they are I just may be banned forever from parks, the beach, and so on. Here in CA city after city are proposing to ban all RSO's forever from all outside recreational areas. It's crazy and just keeps getting more insane. So the city, county, and/or state are going to tell me because I was falsely accused 27 years ago and wrongly convicted that I am banned from all public places? Looks like that just may be the case. I just can't get over how far The Sex Crime Witch Hunt has gone. Well, you can believe this. When I'm off parole and have this GPS Shackle cut off my leg, that tracks my ever move, I will be going any damn place I want to !!! Should Sex Offenders be able to Decorate for Halloween?

Supervisor Jeff Stone of Riverside County introduced an ordinance that would ban sex offenders from putting up Halloween decorations and passing out candy to children.
This is unjust to many of the registered sex offenders, taking away more of their constitutional rights.
According to the article in the Los Angeles Times, "the measure would bar registered sex offenders from answering the door to trick-or-treating children or decorating their homes with Halloween decorations between 12 A.M. and 11:59 P.M. on October 31 each year.
Beyond that, they would be prohibited from leaving any external lights on between 5 p.m. and 11:59 p.m. on Halloween night."When the term sex offender is first heard, one usually thinks that the person must have molested a child or shown off their genitals to a child, but this is not necessarily true.
The dictionary definition of a sex offender is a person who has committed a crime involving a sexual act.
Nowhere does it say that the person committed a sex crime against a child, just a sex crime.
Sex offenses come in many different types.
In order for a person to be registered in the federal system as a sex offender, one must have committed rape or other forms of sexual assault and sexual abuse, obscenity, human trafficking, incest, inappropriate phone calls/sexting, sex with animals, and public order crimes (i.e. public urination, streaking, stealing underwear, etc.).
Of course, what was afore mentioned crimes all can be committed with or against children.
Like any other crime, there are serious and minor differentiations between the many committed.
It is unjust to punish and treat all registered sex offenders the same, when not all of their crimes are the same.
A more serious offense that deserves a more serious punishment is child molestation.
Streaking, or public urination, is a minor offense that does not need a serious course of action.
The registering of sex offenders provides a sense of security and protection for parents in all neighborhoods.
Parents can look up the locations and names of sex offenders in their neighborhoods, which help to prevent and avoid such houses.
Sex offenders should have the right to actively participate in the traditions of Halloween.
Parents should especially be cautious on such a night, taking extra precautions to make sure that nothing happens.
Just because sex offenders decorate their houses or purchase candy to pass out, doesn't mean that their houses will be visited.
Sex offenders are people too, people with sexual deviant behavior, but people nonetheless.
Crimes committed by the offenders are already taken care of and regulated by the government, as unjustly as it is.
It's unnecessary and cruel for more rules and regulations to be implemented.
Although sex offenders are definitely to blame for their actions, it's not right for even more rules to be added.
Halloween has been celebrated for many, many years.
The government has no place in regulating who gets to celebrate a famous and treasured holiday and who doesn't.
Everyone should be wary of sex offenders in their neighborhoods (and those nearby) and should take precautionary measure, but sex offenders don't need any more punishments added on either.
Halloween is a time of tricks, treats, and costumes, not a time of limitation and punishment.

The SAFAR Newsletter

It's Saturday morning and here I am at the library again working on my blog, but I'm pooped out. I've been fighting this battle for over 20 years now. I started in 1989 at Oregon State Penitentiary, where I was serving a 10 year sentence, with The Society Against False Accusations of Rape (SAFAR) Newsletter with the help of Betty Duffey. A woman I did not even know until she read about my wrongful conviction in The Liberator. She helped me for years publishing my newsletter and even flew out to see me. The SAFAR Newsletter was sent out to hundreds of convicts throughout the U.S. and lasted 35 editions. I would cut out articles, paste them to paper, copy, and send them out. Very Old School. Postage was expensive, but I got all the copying for free. A fellow convict (not an "inmate") was a former copy machine repairman and would rig our Law Library's copy machine for me to give me all the copies I needed. It was great! Right under the Law Librarian's/guard's nose. I loved it! I still have copies of most of the editions. Seems like a lifetime ago. I would of never dreamed I'd still be in this fight 20+ years later. Oh well, what can I guy do? Give up? Screw that! Every 2 years in the late 80's and almost the entire 90's I have to go in front of a parole board to see if I was to be paroled. I'd always tell them to go fuck themselves. Here's an Open Letter to the board that was published in 1997 in The Backlash. I have less than a month until I will be forced to live in my van due to Jessica's Law residential restrictions. The nightmare never ends. Take care my friends.

On April 10th, 1997, I am going to go in front of you to be judged again for a crime I did not commit. I have decided that to accept parole would be in conflict of my many years of proclaiming my innocence. I committed no crime to have all these years stolen out of my life and will not beg for parole. Being an innocent man, I refuse your parole offerings, which is my right under laws in effect at the time of supposed crime (September 5th, 1985). I will serve this prison term until my Good-Time Release Date at which time I will be released. See Bollinger vs. Board of Parole.
I have absolutely no remorse for the crime I was wrongly convicted of, I have not a shred of sympathy for my so-called victim, and I owe no one an apology for my actions. How can I have remorse, empathy, or apologize for something I did not do?
I realize my innocence means nothing to you and the fact I have served over six years in an Oregon prison for a crime I did not commit equally means nothing to you. I have come to realize that prisons and prisoners means more money for you and your kind. I refuse parole because I want nothing more to do with the "Corrections" industry in Oregon.
The woman who falsely accused me of rape on September 5th, 1985, did so in order to file a million dollar lawsuit, and because she is mentally ill with a history of falsely accusing men of sex crimes. I was wrongly convicted because vital evidence about my accuser's past and her motives were not allowed in the courtroom due to unconstitutional Rape Shield Laws that hide important evidence from juries in rape trials. And because rape crisis counselors in Salem, Oregon, gave her acting lessons and coached her how to appear as a real rape victim on the witness stand. My accuser, Donna Jean Rowland, of Albany, Oregon, was awarded $24,000.00 for her fraud.

Editor's note: As demonstrated on 60 Minutes or 20/20 in 1996, during Airline crash civil trials, the personal history, including sexual history, of crash victims and their family are routinely introduced into evidence by Airline and Insurance company lawyers. Why is it okay in that case, but not in rape cases?

Because I am not what you call a "sex offender" I will also be filing a lawsuit so I will not be forced to register as a "sex offender" once I am released from prison. I believe over six years out of my life is enough for the state of Oregon and I will not give up my privacy and dignity by being forced to register as a "sex offender." I believe these sex offender community notification laws are unconstitutional and a form of double jeopardy. I will not take part in this further injustice.
I will also not take part in any "sex offender" treatment programs or any other behavior modification classes. As I have stated, I am not a sex offender and was wrongly convicted of Rape because my so-called fair trial was rigged to ensure a conviction. Why should I subject myself to "sex offender" treatment? So some sex offender counselor can justify his job? Would it not be a waste of time for not only myself but also for Oregon's sex offender treatment industry, for me to partake in a "treatment" I do not need or want?
In 1990, another Oregon Parole Board said I should serve four years in prison for my so-called crime and be released. They stated for the record that:

The "victim" was not harmed in any way.
No threats were made at the "victim."
The "crime" contained no violence.
And Vern Faatz, the head of the Parole Board in 1990, said that the "victim" aided in the "crime."

I was to be released from this charge in 1995, but as you recall you ruled that even though I presented you with two positive psych exams that I must have a mental disorder because I refuse to "confess," so I must be too dangerous to be released.
Now, another one of your bought-and-paid-for state psychologists who prostitutes themselves to Oregon's Parole Board interviewed me for half an hour and has come to the conclusion I am in "denial" of my crime, so I must be too dangerous for society. What a farce! His evaluation of my mental and emotional health is not worth the paper it is written on. The only reasons your State Psychologists label prisoners mentally ill is because you pay them, thus allowing you to take away parole dates, keep more prisoners to fill your prison beds, and expand Oregon's multi-million dollar Prison Industry.
The years that you and your kind have stolen out of my life is enough. I owe you nothing more. As a matter of fact, someone owes me and my family an apology. But I know that is beyond those who profit off the backs of innocence and that justice and truth are just empty words to those who line their pockets with money made off of prisons and prisoners. The Oregon Prison Industry has made enough money off my misery. I am not a commodity for your prison warehouses.
I want to be left alone and have my life back. I hope you understand I have too much pride, honor, and integrity to accept your gracious parole. Thank you for your time and effort.

Global Conglomerate 3M and GPS Shackles

This horrid GPS Shackle I have locked on my ankle was made by a company called Pro-Tech which has recently been purchased by the global conglomerate 3M which knows a money maker when It sees one. GPS Shackles for everyone! Gee, we sure will be safe then and just think of all the jobs GPS Shackles provide. So what that these barbaric devices do nothing to protect the public. Big deal that hundreds of million of taxpayer dollars are totally wasted on these GPS Balls and Chains every year. Doesn't matter that Law Enforcement time and energy is taken up by tracking GPS Shackles. 3M is racking in hundreds of millions !!! That's all that matters ! You can bet that 3M will be spending millions on lobbyists and propaganda to promote their new "product". An excellent article in Mother Jones Magazine (a magazine I subscribed to in prison) was recently published on how Hi-Tech Company's are making a killing on GPS for sex offenders. I am a successful professional who was falsely accused of a minor sex crime in 2009. At first I didn’t really take it seriously knowing I was innocent I thought the whole thing would blow over. Well it didn’t!
In 2011 I was convicted.
Because I received a suspended sentence, no humiliating ongoing psychological assessments and no fine I was afraid to appeal in case the sentence might be worse if I was found guilty a second time (I no longer believe in justice).
I am now on the soul destroying sex offenders register and have had to pay huge damages to my accuser. The amounts I have had to pay out in defence fees and compensation have caused me significant debt. If I was not such a strong man this episode could easily have destroyed my life.
Since this happened to me I have taken an active interest in the sex crime witch hunt. This witch hunt is happening in all the developed western countries.
Very few people are standing up for the rights of men who have been convicted of sex crimes. Normally cultivated and intelligent people are capable of behaving like animals when this subject is brought up.
Well they have picked on the wrong guy this time. It’s now time to defeat this witch hunt. I call on all intelligent accused and convicted sex offenders to refuse this isolation and shame and fight back. Some of our most successful men are victims of this oppression. Brothers let’s take this lynch mob down!
Whether you are innocent or guilty doesn’t matter. Sex crimes have the lowest repeat offender rate despite the claims of these facist oppressors.

A Motion for Innocence…And Justice for All?
This was my first work. I wrote it between December 2009 and April 2010. It was a true story about me and my clash with a crooked and one-sided criminal justice system. The real story took place in Michigan, but I had to fictionalize names and locations to avoid any litigation being brought forth by people who wanted no part of this book. I used police reports, court hearings, and witness statements to help compile the work. Mixed with my real adventure, this book was a chance for me to speak. I am very proud of this book and it continues to do well a year and a half after its release. It was originally called A Motion for Innocence, but after hiring a professional editor and repairing the book from stem to stern, And Justice for All? was added to the title. The original cover was also scraped and replaced with a much more effective photo showing a man looking out of jail bars. After receiving a letter from a man claiming that the photo was a copyright infringement, I opted to use my very own photo of a man praying so there would be no mistake as to who the cover art belonged to. The reviews have been outstanding and it seems that the book has definitely hit some very important social issues.

Yesterday, I received an e-mail from an assistant to the producer from the Anderson Cooper's daytime TV show about possibly appearing on his show to talk about Jessica's Law/ Megan's Law and how it continues to punish people long after they finished their prison time/parole. I of course said yes and am waiting to hear back from her. Do I care that my name and face may appear on national TV? No I don't! Won't this effect my life? What life? I live my "life" under Jessica's/ Megan's Law. I don't have a life. I only exist now. Also, I've already been on TV anyway in what was called a "Child Predator Raid" with me handcuffed outside my hotel and MY face for millions to see. Check this insanity out.

The past year I've been living in a fleabag hotel because it's the only place I can find to live because of residential restrictions ( 75% + of this county is off limits to RSO's) and have recently been told that I am to be evicted because the city is building a park down the street. I will be forced to live on the street like a bum due to Jessica's Law. I remember back when I was awaiting trial in the late 1980's I refused Protective Custody and on the Mainline another inmate called me a "Rape-O" so I hit him. After a bloody fight, I was later beaten by guards, stripped naked, and put in The Hole for months until my trial. It was then, sitting in a jail cell beaten and naked I decided that no matter what happens to me I would never give up. NEVER !!!

California Per-prisoner cost doubled in 10 years

The Orange County Register reports:

The average cost to incarcerate a prisoner in California has more than doubled over the past 10 years, according to the Legislative Analyst’s Office.

“The primary reasons are significant increases in employee compensation as well as federal court orders and settlements that have required specific program improvements (such as inmate medical care),” the LAO said.

In 2010, the average cost to incarcerate an inmate in state prison was $46,700. About three–quarters of that was spent on security and inmate health care.

To Cash In on a Predator

State laws that keep a close eye on sex offenders are supposed to protect kids. Are they also meant to enrich high-tech tracking companies?

In February 2005, nine-year-old Jessica Lunsford was kidnapped, raped, and buried alive by a twice-convicted sex offender who lived a few hundred feet from her home in Homosassa, Florida. The crime horrified Floridians, and a little more than two months later, then-Gov. Jeb Bush signed the Jessica Lunsford Act, which mandated a minimum sentence of 25 years for first-time sex offenders who target children under 12 and life sentences for recidivists. It also required some released sex offenders to wear GPS tracking devices for the rest of their lives.
Almost immediately, there were calls for similar legislation across the country. Lunsford's father, Mark, joined the campaign, appearing on Oprah and Larry King Live and winning support from high-profile figures such as Bill O'Reilly, who declared, "This is literally a life-and-death battle to save our youngest and most vulnerable citizens from abuse, torture, and murder." In addition to Florida, 44 other states have since passed what's become known as Jessica's Law (PDF). The laws vary slightly state by state, but all mandate stiff sentences; 39 permit electronic monitoring for released offenders (of those, 24 authorize GPS monitoring). "Instead of them stalking our children, let's stalk them," Lunsford said at a 2006 event promoting the law in California.The push to implement Jessica's Law in all 50 states has been spearheaded by Stop Child Predators, a nonprofit formed in 2005. The group's determination to crack down on criminals who prey on kids is unquestionable. But there is another group with an interest in its work: GPS and tracking companies, which stand to gain as SCP's model legislation spreads. There are an estimated 736,000 registered offenders out there (PDF); satellite tracking equipment costs anywhere from $15 to $20 per person per day (an expense often paid by parolees). One of SCP's official corporate partners is Omnilink Systems, a major vendor of "offender monitoring" devices. SCP president Stacie Rumenap is a member of Omnilink's advisory board. A company brochure quotes her as saying SCP is "proud to support the use of" Omnilink's technology. The company has not said how many states it has sex offender monitoring contracts with.

In 2009, Lunsford, who serves as the chairman of SCP's advisory board, took a $100,000-a-year consulting job with Technology Investors, a Florida firm that creates databases to keep track of sex offenders. He told the St. Petersburg Times that the company's founder, data-mining maven Hank Asher, suggested that he shut down his own nonprofit, the Jessica Marie Lunsford Foundation, so he could "focus on legislation."
There is a universal "desire to keep kids safe," Rumenap notes. She downplays the idea that SCP's work is intended to benefit its corporate supporters. "This is an easy issue for companies to get behind," she says. "Who wants to argue against it?" A petite and charismatic blonde who has served as the deputy director of the American Conservative Union and director of the Conservative Political Action Conference, Rumenap is also the director of corporate relations at the Mercatus Center, a think tank funded by conservative billionaire Charles Koch.
SCP also has close ties the American Legislative Exchange Council, a low-profile yet influential clearinghouse of pro-business state legislation. SCP is an ALEC member, and ALEC adopted its template for a sex offender bill in 2006. Rumenap says that the "access to" legislators that ALEC provides has been "extremely" helpful in getting Jessica's Law into wider circulation. Since April, she has been the co-chair of ALEC's Public Safety and Elections Task Force, which oversees criminal legislation, including a bill that would require parolees and defendants out on bail to submit to GPS monitoring. It would also require ex-cons to "pursue specified education courses," a potential windfall for student loan companies and for-profit colleges.
Those companies, as it turns out, are also well represented in Rumenap's organization: SCP was founded by three executives from the College Loan Corporation, another of its corporate partners. Its board includes the CLC's chief marketing officer and a top lobbyist for the Apollo Group, the parent company of the University of Phoenix.
"I don't doubt that Stop Child Predators is genuinely interested in stopping child predators," says Lisa Graves, executive director of the Center for Media and Democracy, which recently published a cache of more than 800 pieces (PDF) of cookie-cutter legislation promoted by ALEC. No matter how laudable a bill may be, she says, the public has a right to know whether it will financially benefit a particular company. "If people knew that there was a profit motive behind it, they might have greater skepticism about whether this is the best solution or not."

Habeas Corpus Forms for CA's RSOs Residential Restrictions

Above is a link to The Prison Law Office's forms to file a Habeas Corpus Petition asking local CA courts to stay CA's RSOs on Parole law that makes most RSO's here homeless. It has worked in some counties. Not in mine however. I filed this same Petition back while I was still in prison in Oct. of 2010. A judge ruled against it. I've been living in one of the few places I can find in this county where 75%+ of the land mass is off limits to me - a Fleabag Hotel. Now the city plans to build a park down the street and I have been ordered to move by the beginning of the year and start living on the streets or be sent back to prison. Great choice. Live on the streets like a bum or be sent to hell (CA's prison system). If you're in the same boat here in CA like me, I strongly suggest you file the above with your local courts and get the ban on residential restrictions lifted. The forms are all self explanatory. Dear Free-Range Kids: My son was recently subjected to a death threat when a neighbor discovered that he was listed on the sex offender registry. What heinous crime had my son committed that our neighbor deemed worthy of death? “Falling in love.”

He was 17, she told him she was 16. At the time he had no reason to doubt her. A short time later he learned a harsh life lesson. They never got beyond kissing or hand holding, but she wrote in her diary that they had made love. When her mother read the entry in her 14-year-old daughter’s diary she quite justifiably became angry. Without talking with either one of them, she called the police and had my son arrested. He spent 45 days in jail awaiting trial.

Had the mother taken her daughter to the doctor, she would have found out that her daughter was simply voicing a private fantasy. The girl begged her mother to stop the proceedings, but the wheels of “justice” were already in motion.

The girl was so distraught about the situation that she constantly sought to contact my son to apologize and beg him not to hate her. She finally convinced her older sister to help her get in touch with him. One day shortly after sentencing and being put on a strict 3-year probation mandating no contact with his “victim,” my son was walking home from the store a block from our house. A car pulled up behind him and he heard a familiar voice beg, “Please stop and talk to me for a minute, we won’t tell anyone, please!”

His only reaction was to break into a full run. He burst through the front door of our home and collapsed into a pale, quivering heap of fear in the middle of the floor. He managed to shakily mumble enough for me to realize what had just happened. I immediately took him to the police station and had them document exactly what had happened. Only with their assurance that he had done the right thing and that everything would be OK, could he finally calm down enough to breathe.

My son was quite shy around girls to begin with and she was his first love. As things stand right now, he may very well never have another. He never finished high school due to his probation rules, and will be required to register twice a year for the rest of his life. He has lost every job he has been able to find, due to his listing on the registry. He can never join the military, or even follow his lifelong dream of a career in music, even though he is a talented singer/songwriter and drummer.

Why not? The laws work this way: His sentence was 3 years’ probation and 25 years on the registry in his state of conviction, Michigan. He couldn’t keep a job in Michigan, he kept losing them because of the registry, resulting in homelessness. Homelessness and joblessness are parole violations, so he was sent to jail for six months. After two more trips to jail for failure to register — resulting in three more months in jail — he came here to South Carolina to live with us. As long as he can keep a roof over his head and registers when required, he will be safe. A third failure to register could send him to prison for a mandatory 5 year sentence. Unfortunately, in our state, sex offender registration is lifetime for everyone.

He cannot pursue his musical career because it costs money (which neither he nor we have), for his instruments and upkeep, advertising, etc. Plus, if you are on the registry you have to go in and report everywhere you are employed. Which means if he had a gig in, say, Seattle, he would have to report the address of his performance, the length of time he will be there, where he would be staying for the duration, etc. This is required for each and every change, notwithstanding the fact that anytime he leaves his home address for more than 3 days, it has to be approved with both the sheriff’s department here and the sheriff’s department at his destination, and either of them are at liberty to deny his request at any time.

I also wanted to mention, that although he does not have a driver’s license, he is required to register OUR car on his registry listing, which makes public, the make, model, color and plates of our car. This may seem trivial to some, but to a vigilante our car becomes a target, regardless of who is driving it.

Of all the child sex abuse allegations levied against retired Penn State football coach Jerry Sandusky, none perhaps is more disturbing than the report that he used his non-profit foundation Second Mile to gain access to young boys — not only for himself, but for donors to his organization. Sexually assaulting children is by itself a monstrous act to contemplate; the idea that they may be pimped out to others is nearly unfathomable.
Yet to hear the mainstream media report it might lead one to believe that the problem of child sexual slavery is reaching horrifying levels in the U. S., and while it’s certainly not something to be ignored, it’s also not the “epidemic” the alarmists — and especially law enforcement — have portrayed it as.
One example of this media-fueled hysteria is a report released in September 2010 by the Women’s Funding Network, which earned them a national spotlight, not to mention an invitation from a House subcommittee, before which WFN chief program officer Deborah Richardson breathlessly warned that child prostitution was “exploding” in the U. S. — anywhere from 20 percent in New York to 65 percent in Minnesota. Lock up your daughters!
The study focused in particular on classified ad sites such as Backpage.com and Craigslist, whose adult sections, it claimed, were enabling the rapid expansion of the child sex trade. Craigslist succumbed to pressure brought by numerous U. S. Attorneys and closed its adult section, but The Village Voice, whose parent company owns Backpage, decided to do its own review of the study, and found it was based on looking at the pictures of girls in sex ads on the Internet — and making assumptions that a certain percentage of those ads must be for underage sex workers. There was nothing remotely scientific about the data acquisition or methodology; the research group almost literally made up most of the data.
Despite its questionable methods and conclusions, the study’s findings blew across the media landscape like a summer wildfire. Its numbers were reported without any critical analysis in papers such as USA Today and the Detroit Free Press, and cited by actress (and sex trafficking activist) Demi Moore, whose Web site still links to the WFN study.
None of this means that the child sex trade doesn’t exist, or that there aren’t a lot more Jerry Sanduskys lurking out there. But it does mean that publicizing bogus studies without any critical context can lead to bad policy decisions by lawmakers and law enforcement agencies. And we end up with Megan’s Law and Jessica’s Law and the Adam Walsh Act and other ill-conceived laws, all named after dead kids to make them seem critical to civilization’s continued existence, and not the further expansion of state power that they really are.
The air had barely escaped an Orlando courtroom following the Casey Anthony trial, in which she was found not guilty of murdering her two-year-old daughter, before an activist began pushing for a “Caylee’s Law”, which would have made it a felony for parents not to report a missing child within 24 hours. It is precisely during these times of high emotion, when sensationalized cases of crimes against children make headlines and inflame radio personalities, that such laws should not be considered. For they often serve only to increase the power of the police state without doing much to protect their intended beneficiaries. Politically popular and emotionally resonant they may be, but dead kids make for bad laws.
Raising awareness of social ills is important, but so is truth and justice, and the media serve neither when they engage in reporting that looks less like responsible journalism and more like alarmist propaganda for an ever-encroaching state.

$142.42 a Day to Stay in CA Jails?

In one southern California county, prisoners will soon have to pay for the privilege of staying in jail.
Riverside County, California will start charging prisoners $142.42 per day of their prison stay, CNN Money reports. The county’s board of supervisors approved the measure on Tuesday as a way to save an estimated $3 to $5 million per year. Not every prisoner will be forced to pay up, however. The county will review each prisoner’s case individually to determine if they can afford the fee.
The fee comes as the California correctional system continues to struggle with budget woes. Last month, in an effort to save money, the state transferred responsibility for lower-level drug offenders, thieves and other convicts to counties. The “prison realignment” is one of many measures the state has taken in recent years to close its budget gap. The California Supreme Court is considering this week whether the state broke the law when it used re-development funds to close a shortfall a few years ago, according to the Wall Street Journal.

Los Angeles County's jails could run out of space as early as next month because of an influx of state prisoners, prompting officials to consider releasing potentially thousands of inmates awaiting trial.
The state's new prison law, which establishes a practice known as realignment, is expected to send as many as 8,000 offenders who would normally go to state prisons into the L.A. County Jail system in the next year.
Currently, defendants awaiting trial account for 70% of the jail population, but Sheriff Lee Baca said that might need to drop to 50%. The department is studying a major expansion of its electronic monitoring and home detention programs to keep track of inmates who are released.

Life Sucks! We Got to Deal With It

   Well, here I be at the library again. Got to work on this blog here since I don't have a computer at home. A home I Will be soon evicted from because of Jessica's Law in California. I will be joining thousands of RSO's on parole in CA that are forced to live on the streets due to residential restrictions. It's pure insanity! I've been running, living underground, and being sent to prison for over 20 years now. I'm tired. I'm 50 now and the rabbit has been run out of me. Breaking out of prison and jumping parole a dozen times I learn that it is possible to live totally off the grid, but it sure is stressful being a fugitive. I've also refused to register in the past. The last time was when Jessica's Law was passed by CA voters in 2006. I wasn't captured until 2008 and was sentenced to 4 more years in prison. Going to spend the day looking for a new hotel room to hold up in until I parole in 2013 and if I can't find anywhere to live, I'll be living in my van. Now that's going to be a nightmare. Making plans to live in my van already because in this county 75+ of the land mass is off limits to RSO's and I don't think any of the hotels here are left that we can live in. A couple weeks ago I was informed that all RSO's will be evicted at 4 hotels in my area because the city is building a park down the street. 10 years ago, I would have never even reported to the parole office or allow them to lock a GPS Tracking Shackle onto my ankle and I sure would not be registering. I'm old now and have been fighting The Sex Crime Witch Hunt for since 1985. I'm pooped. It's all so crazy. Get this, the thousands of RSO's on parole here and who were forced into homelessness are not allowed in any one spot for more than 2 hours because it maybe within 2,000 feet from a park, school, ect.... If a RSO in CA does stay in any one place for more than 2 hours they are sent back to prison. 2 hours in any one place is a crime in CA? It is now and has been since 2006. Homeless RSO's have to always be on the move and are constantly harassed, degraded, and humiliated by local police. The only place homeless RSO's are allowed to stay more than 2 hours at, is the bush they are sleeping under at night. I've heard that being homeless and having to change your location every 2 hours drives a guy crazy and most wind up back in prison.
